1. Introduction

Welcome to Indra Labs, LLC, operating as IndraLabs ("we", "our", or "us"). These Terms and Conditions ("Terms") govern your use of our mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.

Brooke is our Pilates booking and payments application. These Terms also apply to Brooke and its SMS login verification program, operated by Indra Labs, LLC in New York City, New York.

2. Use of the App

You are granted a non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms. You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the App or its related systems.
• Disrupt or interfere with the integrity or performance of the App.
• Use any automated means to access the App for any purpose without our express written permission.

3. User Accounts

To access certain features of the App, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized use of your account.

4. Intellectual Property

All content, features, and functionality within the App, including but not limited to text, graphics, logos, and software, are the exclusive property of IndraLabs or its licensors and are protected by intellectual property laws. You agree not to reproduce, distribute, modify, or create derivative works of any content without our prior written consent.

5. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

6. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the App's operation or the information, content, materials, or products included on the App.

7. Limitation of Liability

To the fullest extent permitted by law, IndraLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the App.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

9. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on the App. By continuing to access or use the App after revisions become effective, you agree to be bound by the updated Terms.

10. Brooke SMS Login Verification

When you enter your mobile number in Brooke and select "Text my code" or "Text code", you consent to receive an automated SMS containing a one-time code to create an account or sign in. This program sends login verification messages only, not marketing or promotional messages. Accepting these Terms alone does not enroll you in SMS messaging.

Message frequency: one login text per request. Each additional code request may generate another text. Message and data rates may apply under your mobile carrier plan. Consent to SMS is not a condition of purchasing Pilates sessions; receiving a code is required to complete the SMS sign-in flow.

Reply STOP to opt out of Brooke SMS messages. You may receive one final message confirming your opt-out. After opting out, you will not receive further login codes unless you re-enroll. For help, reply HELP or contact scmp197@gmail.com.

SMS delivery depends on your carrier and network availability. Carriers are not liable for delayed or undelivered messages. Keep verification codes private and do not share them with others.
